Supporting Seth’s Law in California

California’s state legislation aims to bring attention to bullying and cyberbullying to create a safer learning environment for all students regardless of who they are.

California has state legislation to help prevent bullying and cyberbullying in schools, which has been strengthened to include “Seth’s Law” (California Assembly Bill AB9) addressing bullying based on one’s actual or perceived sexual orientation and gender identity/gender expression, as well as race, ethnicity, nationality, gender, disability, and religion.

What is bullying?

California’s state legislation defines bullying as, “any severe or pervasive physical or verbal act or conduct, including communications made in writing or by means of an electronic act, as defined, including, but not limited to, sexual harassment, hate violence, or harassment, threats, or intimidation, that has the effect or can reasonably be predicted to have the effect of placing a reasonable pupil, as defined, in fear of harm to that pupil’s or those pupils’ person or property, causing a reasonable pupil to experience a substantially detrimental effect on his or her physical or mental health, causing a reasonable pupil to experience substantial interference with his or her academic performance, or causing a reasonable pupil to experience substantial interference with his or her ability to participate in or benefit from the services, activities, or privileges provided by a school.”

What does “Seth’s Law” require schools to do?

 – Adopt a strong anti-bullying policy that specifically identifies prohibited bases for bullying, including one’s actual or perceived sexual orientation and gender identity/gender expression.

 – Adopt a specific process for receiving and investigating complaints of bullying.

 – Publicize the anti-bullying policy and complaint process in all schools and offices.

 – Post material on the district website to support victims of bullying and must update annually.

 – It specifically contains the following requirement, “If school personnel witness an act of discrimination, harassment, intimidation, or bullying, he or she shall take immediate steps to intervene when safe to do so.” (Education Code Section 234.1(b)(1))
